Social Security Child Benefits
Attorney in Rochester Hills, MI
Children may qualify for Social Security benefits based on a parent’s work record or due to a disability of their own. At Grech Law Firm Attorney & Counselor, we help Michigan families understand their options and navigate the process with confidence.
What Are Social Security Child Benefits?
The Social Security Administration provides benefits for children in two primary situations. First, children of workers who are disabled, retired, or deceased may qualify for monthly benefits based on the parent’s earnings record. Second, children with their own qualifying disabilities may be eligible for Supplemental Security Income (SSI) if they meet the medical and financial criteria.
Both benefit types have different eligibility requirements and application processes, but each can provide critical financial support for Michigan families.
Child Benefits Based on a Parent's Work Record
If a parent receives SSDI, retires, or passes away, their dependent children may qualify for monthly Social Security benefits. Generally, eligible children must be under age 18 — or up to 19 if still enrolled in high school full-time — and unmarried. In some cases, adult children with disabilities that began before age 22 may also qualify based on a parent’s record.
The benefit amount is calculated as a percentage of the parent’s Social Security benefit. Multiple children in the same family may each receive benefits, though a family maximum limit applies.
SSI for Children With Disabilities
A child under age 18 with a medically determinable physical or mental condition causing marked and severe functional limitations may qualify for SSI. The condition must be expected to last at least 12 months or result in death. The SSA evaluates how the condition limits the child’s functioning compared to other children of the same age — not against an adult standard of work ability.
Financial eligibility is also required. The SSA considers the income and resources of parents living in the same household when determining a child’s SSI eligibility.
